1. Agreement to Terms

By accessing or using the Killzone Gaming (KZG) - Servers ("Service"), you agree to be bound by these Terms of Service.

These Terms are governed by the laws of Victoria, Australia. If you do not agree to these terms, you must not use our Service.

2. Service Availability & Third-Party Data

We provide this Service on an "AS IS" and "AS AVAILABLE" basis. While we strive for accuracy, we rely on third-party APIs (including gamedig.kzg.gg and Steam) for server status, player counts, and metadata.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free;
• Third-party data (server status, player lists) will be accurate or real-time;
• Any specific game server will remain online or accessible.

3. Australian Consumer Law (Liability)

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that you may have under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law that cannot be excluded ("Non-excludable Rights").

To the maximum extent permitted by law, our liability for a breach of a Non-excludable Right is limited, at our option, to:

• The resupply of the services; or
• The payment of the cost of having the services resupplied.

For all other claims, KZG shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data or profits) resulting from your use of the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose under Victorian or Australian law;
• Attempt to reverse engineer, scrape, or excessively query (DDoS) our APIs or infrastructure;
• Interfere with the proper working of the Service or bypass any security measures.

5. Data and Local Storage

By using this Service, you acknowledge that we store technical data locally on your device (such as ping test results and consent preferences) to optimise performance.

6. Termination

7. Governing Law

Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
